Terms of Use

Pillers & Richmond ("we," "us," or "our") owns and operates pillerslaw.com and other websites that link to these Terms of Use (individually, a "Site," and collectively, the "Sites"). Through the Sites, Pillers & Richmond provides information, resources, electronic communications, and other offerings related to our legal services (each a "Service" and collectively, the "Services"). References to the Sites include the Services.

Pillers & Richmond may change, suspend, modify, or discontinue all or any part of the Sites in its sole discretion with or without notice. Pillers & Richmond is not liable if all or any part of a Site is, for any reason, unavailable at any time or for any period. Pillers & Richmond reserves the right to block or deny access to any of the Sites to anyone at any time for any reason. Pillers & Richmond is not obligated to correct or update any information or content on the Sites.

No Attorney-Client Relationship; No Legal Advice

The Sites and Services are provided for general informational and communication purposes only and do not constitute legal advice. Accessing or using the Sites, or communicating with Pillers & Richmond through a Site, email, text message, or other electronic means, does not by itself create an attorney-client relationship. An attorney-client relationship is formed only through a written engagement agreement signed by Pillers & Richmond and the client. Do not send confidential or time-sensitive information unless an attorney-client relationship has been established and Pillers & Richmond has authorized the method of communication.


General Terms

These terms of use (together with any additional terms, as described below) ("Terms of Use") are an agreement between Pillers & Richmond and the individuals that use the Sites ("users," "you," or "your"). We may now or in the future offer multiple platforms (the "Pillers & Richmond Platforms") through our Sites for use in accessing our Services. To use the Platforms, you must adhere to any additional terms and conditions specific to each Platform, as identified below and/or presented to you at the time you use the Platforms. Certain offerings on the Sites may be free of charge or offered for a fee, and we reserve the right to change what Services are offered free of charge or for a fee, and the fees charged for any given Service.

Text Messaging Terms

If you provide a mobile telephone number and consent to receive text messages from Pillers & Richmond, you authorize us and our service providers to send text messages to that number concerning appointments, case-related communications, document requests, billing, account notifications, and other matters related to our services. Message frequency varies. Message and data rates may apply. Consent to receive text messages is not a condition of obtaining legal services.

You may revoke consent and opt out at any time by replying STOP, CANCEL, END, QUIT, UNSUBSCRIBE, or OPT OUT, or by using another reasonable method communicated to us. After an opt-out request, we may send one confirmation message and will process the request as required by applicable law. For assistance, reply HELP or contact us through the Site. Mobile carriers are not liable for delayed or undelivered messages.

You represent that you are the subscriber or customary user of the mobile number you provide and agree to notify us promptly if the number changes or is reassigned. Text messaging is not guaranteed to be secure or confidential. Do not send Social Security numbers, financial account information, medical information, or other highly sensitive information by text unless we specifically instruct you to do so. Our collection and use of information through the text messaging program is governed by our Privacy Policy.

Acceptable Use

You may use the Sites only for lawful purposes and in accordance with these Terms of Use. You may not interfere with Site operation or security; attempt unauthorized access; introduce malicious code; scrape, harvest, or collect information through automated means except as permitted by us; impersonate another person; submit false or misleading information; infringe another person’s rights; or use the Sites or Services to transmit unlawful, threatening, abusive, deceptive, or unsolicited communications.

Intellectual Property

The Sites and their content, features, design, text, graphics, logos, and other materials are owned by or licensed to Pillers & Richmond and are protected by applicable intellectual property laws. You may access and use Site content for your personal, noncommercial use only. No other right or license is granted. You may not reproduce, distribute, modify, publicly display, sell, or exploit Site content without our prior written permission.

Limitation of Liability

TO THE FULLEST EXTENT PERMITTED BY LAW, PILLERS & RICHMOND AND ITS ATTORNEYS, EMPLOYEES, AGENTS, SERVICE PROVIDERS, AND AFFILIATES WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES, OR FOR LOSS OF DATA, USE, PROFITS, OR BUSINESS, ARISING FROM OR RELATED TO THE SITES OR SERVICES. NOTHING IN THESE TERMS EXCLUDES OR LIMITS LIABILITY THAT CANNOT LAWFULLY BE EXCLUDED OR LIMITED.

Indemnification

To the fullest extent permitted by law, you agree to defend, indemnify, and hold harmless Pillers & Richmond and its attorneys, employees, agents, service providers, and affiliates from claims, liabilities, damages, judgments, losses, costs, and expenses arising from your violation of these Terms of Use, misuse of the Sites or Services, or infringement of another person’s rights.

Governing Law; Severability

These Terms of Use are governed by the laws of the State of Iowa, without regard to conflict-of-law principles. If any provision is held invalid or unenforceable, it will be enforced to the maximum extent permitted, and the remaining provisions will remain in effect. Failure to enforce a provision is not a waiver. These Terms of Use and any applicable additional terms constitute the entire agreement concerning the Sites and Services.

Changes to These Terms

We may revise these Terms of Use from time to time by posting the updated version on the Sites and updating its effective date. Changes apply prospectively when posted unless otherwise stated.
